Is Zolpidem legal in Germany?

Zolpidem is a named narcotic in the prescribable tier of the German schedules, which is worth stating because it is not a benzodiazepine and is often assumed to be outside the narcotics regime for that reason. The dossier records the Anlage III row of the Betäubungsmittelgesetz as „Zolpidem | - | N,N-Dimethyl-2-[6-methyl-2-(p-toly)imidazo[1,2-a]pyridin-3-yl]acetamid“, and the third column shows an imidazopyridine, a different ring system entirely from the benzodiazepines listed alongside it. Germany has given it a line of its own rather than reaching it by analogy. Placement is under BtMG § 1 Abs. 1 and the tier is Anlage III, the marketable and prescribable one, so the substance is controlled through its supply route.

Consequences if caught

Capital exposure: none. The dossier's penalty column records that no death-penalty regime applies. The penal provisions are BtMG §§ 29 bis 30a and the dossier gives the ceiling only: not less than five years under § 30a Abs. 1, with a determinate sentence capped at fifteen years by StGB § 38 Abs. 2. Because the medicine is widely dispensed, the offence in practice is about provenance rather than identity: tablets held or passed on outside the dispensing route are inside the offence even though the same product is lawful in a pharmacy.
