Is 1P-LSD legal in Germany?

Legal status

1P-LSD is placed in NpSG Anlage 1 Nr. 5.2, the Δ9,10-Ergolene group, in Germany, and a compound inside that group is prohibited without that alone supplying a penalty. It is reached by the Neue-psychoaktive-Stoffe-Gesetz and not by the Betäubungsmittelgesetz, and it is reached as a member of a printed structure group rather than by a line that names it. The group's opening words read „Eine von Δ9,10-Ergolen abgeleitete Verbindung ist jede chemische Verbindung, die von der... Grundstruktur abgeleitet werden kann“, with the R1 limb reading „eine Alkylcarbonylgruppe (Alkylrest bis C4, Bindung der Carbonylgruppe an den Stickstoff des Ergolens)“. The propionyl group on the ring nitrogen is what has to be measured against that printed R1 limb, and the limb caps the alkyl residue at four carbons, so the result is a structural finding and not a naming one. An Anlage 1 group is reached through § 2 Nr. 1 Buchst. a of the Act, which is a different entry route from the Anlage 2 lines under Buchst. b, and a different regime again from BtMG Anlage I, II or III. Nothing in the NpSG Anlage 1 Nr. 5.2 entry places the substance in a BtMG Anlage.

Consequences if caught

Capital exposure: none. Germany has no death penalty and nothing in this regime reaches one. The prohibition and the offence are two separate lists here, and this cell keeps them apart because the Act does. Satisfying the Nr. 5.2 structure test makes the compound a new psychoactive substance, and that engages the prohibition in NpSG § 3 Abs. 1 Nr. 1, whose forbidden handlings include acquiring the substance and possessing it as well as trading in it, manufacturing it, placing it on the market, moving it into or out of the territory and administering it to another person. The offence provision is narrower. NpSG § 4 Abs. 1 punishes trading, placing on the market and administering to another, together with manufacture or import for the purpose of placing on the market, and it does not carry acquisition or possession across from the prohibition list. So a compound inside the ergolene group is prohibited without that alone supplying a penalty. Where the offence is made out the basic band is imprisonment of up to three years or a fine, and the figure the dossier records as the ceiling for this row is § 4 Abs. 3, „Freiheitsstrafe von einem Jahr bis zu zehn Jahren“, one to ten years, which is the aggravated limb and not the ordinary one. There is no prescription route here to attach a traveller rule to. The substance is not placed in any of the three BtMG Anlagen, so the marketable and prescribable tier does not arise, and the NpSG is a prohibition statute rather than a supply statute: its exemptions in § 3 Abs. 2 are for recognised commercial, industrial and scientific uses, not for a patient.
