Is LSD legal in Germany?
Also known as: acid
- Legal status
- LSD is listed in Anlage I of the Betäubungsmittelgesetz under its international non-proprietary name. The dossier records the row as „Lysergid | N,N-Diethyl-D-lysergamid (LSD,LSD-25) | N,N-Diethyl-6-methyl-9,10-didehydroergolin-8β-carboxamid“, so the first column carries the name a schedule uses, the second carries the chemical designation and both market abbreviations, and the third fixes the ergoline with its configuration at position eight. The entry is written at this one molecule, which is why the analogues sold around it are not on this line: Germany reaches those, if at all, through the separate ergolene structure group in the new psychoactive substances statute, a different Act with a different prohibition. Placement here is under BtMG § 1 Abs. 1 and the tier is Anlage I, the non-marketable one.
- Consequences if caught
- Capital exposure: none. The dossier's penalty column records that no death-penalty regime applies. The provisions are BtMG §§ 29 bis 30a and the dossier gives the ceiling: not less than five years under § 30a Abs. 1, with the fifteen-year limit on a determinate sentence in StGB § 38 Abs. 2. No ordinary band is recorded and none is stated. Because the entry is drawn at the diethylamide with a fixed configuration, the analysis decides which regime applies at all: material answering this description is a narcotics case, and a substituted lysergamide is a question for the other statute with its own separate consequences.
- If prescribed or medical
- Annex I substances are non-prescribable; there is no traveller-medicine pathway.
- Documentation
- EU/Schengen travel: carry prescribed narcotics for up to 30 days with an Article 75 Schengen certificate, completed by your doctor and authenticated by the competent Land health authority (one certificate per drug). From outside Schengen: carry a multilingual doctor's certificate authenticated by your home-country health authority. Ordinary (non-narcotic) medicines: up to a 3-month personal supply.
- Germany, Betäubungsmittelgesetz, Anlage I, the table row „Lysergid | N,N-Diethyl-D-lysergamid (LSD,LSD-25) | N,N-Diethyl-6-methyl-9,10-didehydroergolin-8β-carboxamid“, placed by § 1 Abs. 1 with penal provisions at §§ 29 bis 30a
