Is Nimetazepam legal in Germany?
Also known as: erimin, happy five
- Legal status
- Nimetazepam is a named narcotic in the prescribable tier of the German schedules, which is a notably different position from the one it holds in several Asian jurisdictions where it is treated as a prohibited drug. The dossier records the Anlage III row of the Betäubungsmittelgesetz as „Nimetazepam | - | 1-Methyl-7-nitro-5-phenyl-1,3-dihydro-2H-1,4-benzodiazepin-2-on“. The nitro group at position seven and the methyl on the ring nitrogen are what identify it against the other nitrobenzodiazepines in the same table. Placement is under BtMG § 1 Abs. 1 and the tier is Anlage III, the marketable and prescribable one, so German law controls the substance through its supply route rather than prohibiting it.
- Consequences if caught
- Capital exposure: none. The dossier's penalty column records that no death-penalty regime applies in Germany, and that is worth stating plainly on this substance because the position elsewhere is materially harsher. The provisions are BtMG §§ 29 bis 30a and the dossier records the ceiling: not less than five years under § 30a Abs. 1, with a determinate sentence capped at fifteen years by StGB § 38 Abs. 2. No ordinary band is recorded and none is stated. The offence here is the handling outside an authorised route rather than the possession of a forbidden substance.
- If prescribed or medical
- Anlage III is prescribable. A medicine containing it may be prescribed in Germany, and a prescribed medicine carried with its prescription is lawful. For controlled medicines on Schengen travel see documentation.
- Documentation
- For a prescribed controlled medicine on Schengen travel, carry a Schengen certificate issued under article 75 of the Convention implementing the Schengen Agreement, together with the original packaging and the prescription.
- Germany, Betäubungsmittelgesetz, Anlage III, the table row „Nimetazepam | - | 1-Methyl-7-nitro-5-phenyl-1,3-dihydro-2H-1,4-benzodiazepin-2-on“, placed by § 1 Abs. 1 with penal provisions at §§ 29 bis 30a
