Is MDMA legal in Germany?
Also known as: molly, ecstasy
- Legal status
- MDMA is listed in Anlage I of the Betäubungsmittelgesetz. The dossier records the row as „- | Methylendioxymetamfetamin (MDMA) | [1-(1,3-Benzodioxol-5-yl)propan-2-yl](methyl)azan“, with the German chemical designation and the abbreviation in the second column and the N-methylated benzodioxole amine in the third. The first column is empty, so the operative name in the German table is the chemical one rather than an international non-proprietary name, which is the opposite arrangement from the demethylated relative listed separately in the same Anlage. Placement is under BtMG § 1 Abs. 1 and the tier is Anlage I, the non-marketable one, so no lawful supply route attaches to the listing.
- Consequences if caught
- Capital exposure: none. The dossier's penalty column records that no death-penalty regime applies in Germany. The penal provisions are BtMG §§ 29 bis 30a and the dossier gives the ceiling only: imprisonment of not less than five years under § 30a Abs. 1, with StGB § 38 Abs. 2 capping a determinate sentence at fifteen years. The ordinary band is not recorded in the dossier and this cell does not supply one from elsewhere. Exposure runs to the molecule in the third column, which matters for pressed tablets: what was intended and what was sold do not settle the charge, and a tablet containing a different substituted amphetamine engages that substance's own entry.
- If prescribed or medical
- Annex I substances are non-prescribable; there is no traveller-medicine pathway.
- Documentation
- EU/Schengen travel: carry prescribed narcotics for up to 30 days with an Article 75 Schengen certificate, completed by your doctor and authenticated by the competent Land health authority (one certificate per drug). From outside Schengen: carry a multilingual doctor's certificate authenticated by your home-country health authority. Ordinary (non-narcotic) medicines: up to a 3-month personal supply.
- Germany, Betäubungsmittelgesetz, Anlage I, the table row „- | Methylendioxymetamfetamin (MDMA) | [1-(1,3-Benzodioxol-5-yl)propan-2-yl](methyl)azan“, placed by § 1 Abs. 1 with penal provisions at §§ 29 bis 30a
