Is Delta-8-THC legal in Spain?

Confirmed against a primary sourceVerified July 14, 2026
Legal status
Controlled — delta-8-THC (Δ8-THC) is caught as a tetrahydrocannabinol under the Ley 17/1967 de Estupefacientes and the 1971 Convention lists Spain transposes (Schedule I lists tetrahydrocannabinols and their isomers), so delta-8 is controlled as an isomer of THC. Distinct from cannabis (private personal use decriminalised) and from lawful hemp CBD; consumer delta-8 sale is not lawful. No death penalty.

Trafficking is criminal (prison); personal use/possession in public is an administrative sanction under the Ley de Seguridad Ciudadana.
If prescribed or medical
No recognised medical use; delta-8-THC is not a prescribable medicine.
Documentation
No lawful personal import of a controlled tetrahydrocannabinol.
