Is THC-P legal in Spain?
- Legal status
- THC-P (tetrahydrocannabiphorol) is a controlled psychotropic substance — 'tetrahidrocannabiforol (delta-9-THCP; THCP)', together with delta-8-THCP and THCP-O (and HHC/HHCP family compounds), was added to List II of the annex to Real Decreto 2829/1977 by Orden SND/380/2025 (published in the BOE on 22 April 2025), in force 23 April 2025. This diverges from cannabis, whose private personal use is decriminalised; THC-P is now subject to psychotropic-control offences. No death penalty.
- Consequences if caught
- Commercialisation and trafficking of a listed psychotropic are criminal under Arts 368–378 of the Código Penal (imprisonment scaled by quantity and harm); personal possession/use in public is an administrative offence under the Ley Orgánica 4/2015.
- If prescribed or medical
- No therapeutic use recognised; List II status without an authorised medicine leaves no prescription route.
- Documentation
- Retail sale and supply of THC-P became unlawful from 23 April 2025; no lawful consumer market. Do not import.
