Legal status
Controlled — delta-8-THC (Δ8-THC) falls within the 'tetrahydrocannabinol' entry on Opiumwet Lijst I as an isomer of THC. In practice semi-synthetic hemp-derived delta-8 sits in an enforcement grey zone (not sold openly, distinct from tolerated Lijst II herbal cannabis in coffeeshops); its precise treatment as a hard-drug tetrahydrocannabinol versus the cannabis regime is left to confirmation. No death penalty.
Consequences if caught
As a Lijst I substance, illegal to produce/traffic — up to 12 years for hard-drug trafficking; the coffeeshop tolerance does not extend to isolated tetrahydrocannabinols.

No recognised medical use; delta-8-THC is not a prescribable medicine.
