Legal status
CBD (cannabidiol) is sold as a consumer product but sits under the Opium Act (Opiumwet): CBD extracted from cannabis is lawful only where THC is at a negligible trace level, and ingestible CBD is an unauthorised Novel Food; medicinal cannabis is prescription-only.
Consequences if caught
Trace-THC CBD cosmetics and oils are tolerated in retail, but a CBD product with more than trace THC falls under Opium Act List II (cannabis) controls.
If prescribed or medical
Medicinal cannabis containing CBD/THC is dispensed on prescription through the Office of Medicinal Cannabis (BMC); distinct from cannabis, a tolerated List II soft drug.
Documentation
Keep documentation showing negligible THC content; medicinal cannabis requires a doctor's prescription.
