Is Delta-8-THC legal in Germany?

Legal status
Controlled — delta-8-THC (Δ8-THC) was added to the Neue-psychoaktive-Stoffe-Gesetz (NpSG) by the amendment in force 27 June 2024, which scheduled a batch of semi-synthetic cannabinoids. It is caught as a tetrahydrocannabinol; chemically it also falls within the 'Tetrahydrocannabinole' group of BtMG Anlage I. Sharp contrast with cannabis, which was DELISTED from the BtMG by the Cannabis Act (CanG/KCanG) on 1 April 2024 — delta-8 stayed prohibited. No death penalty.
Consequences if caught
Illegal to manufacture, place on the market, import, export or trade; NpSG offences carry up to 3 years (up to 10 for endangering minors or commercial dealing).
If prescribed or medical
No recognised medical use; delta-8-THC is not a prescribable medicine (unlike dronabinol/delta-9-THC).
Documentation
No lawful personal import of an NpSG-listed substance.
