Is HHC legal in Germany?

Legal status

Controlled narcotic. Hexahydrocannabinol is named in Anlage II of the Betäubungsmittelgesetz, the schedule of substances that are tradeable but not prescribable. The entry prints "Hexahydrocannabinol (HHC)" in its other-names column and the chemical name "6a,7,8,9,10,10a-Hexahydro-6,6,9-trimethyl-3-pentyl-6H-dibenzo[b,d]pyran-1-ol". Consequences if caught

Capital exposure: none. Germany has no death penalty and this statute provides no route to one. Answering the printed group makes the compound a new psychoactive substance, and that engages the prohibition in § 3 Abs. 1 Nr. 1, which forbids acquiring and possessing it as well as trading in it, manufacturing it, placing it on the market, moving it across the border and administering it to another. The offence provision does not follow the prohibition that far: § 4 Abs. 1 reaches trading, placing on the market and administering to another, plus manufacture or import for the purpose of placing on the market. So a vendor's position and a purchaser's position are not the same position, although both are on the wrong side of the prohibition.
