Is THC-P legal in Germany?
- Legal status
- THC-P (tetrahydrocannabiphorol) is caught by the Neue-psychoaktive-Stoffe-Gesetz (NpSG): its annex controls a structural group of '6H-Benzo(c)chromen-1-ol (dibenzopyran) derivatives' bearing saturated or unsaturated carbon side chains up to C10, and THC-P's heptyl (C7) side chain on the tetrahydrocannabinol/benzo[c]chromene core falls squarely within that group (added by the NpSG amendment enacted mid-2024, in force from 27 June 2024). Notably, this contrasts with cannabis, which was removed from the BtMG for adult personal use by the Cannabis Act (CanG, 1 April 2024) — THC-P remains controlled through the separate NpSG designer-drug regime. No death penalty.
- Consequences if caught
- The NpSG criminalises manufacture, trade, import, export and administration (Inverkehrbringen) of THC-P products — up to 3 years' imprisonment, or up to 10 years where it endangers many people or a minor; possession/consumption of small amounts is not itself an NpSG offence by design.
- If prescribed or medical
- No medical authorisation; the NpSG permits only defined industrial/scientific uses, so there is no prescription route.
- Documentation
- E-liquids, distillate and flower containing THC-P may not be sold or supplied; possession of small personal amounts is not punishable, but commercial handling is.
