Is THC-P legal in Germany?

Caught by an Anlage 1 group of the Neue-psychoaktive-Stoffe-Gesetz, not by a narcotics listing, and the group membership produces a prohibition rather than a penalty in itself. THC-P is reached by the Neue-psychoaktive-Stoffe-Gesetz through a printed side-chain allowance rather than by any name. It sits at Anlage 1 Nr. 2.3.2 Buchst. c, and the limb reads „Der Rest R3 kann aus Wasserstoff oder... Kohlenstoffkette (gesättigt oder ungesättigt, verzweigt oder nicht verzweigt, bis C12)... bestehen.“, which allows a carbon chain, saturated or unsaturated, branched or unbranched, up to twelve carbons. The heptyl chain that defines this cannabinoid sits inside that allowance, so the compound answers the group on a number rather than on a name. Entry is through § 2 Nr. 1 Buchst. a, the Anlage 1 group route, which is not the Anlage 2 route for individually listed substances.

Consequences if caught

Capital exposure: none. Germany has no death penalty and this statute provides no route to one. What the group membership produces is a prohibition rather than a penalty in itself. The prohibited handlings in § 3 Abs. 1 Nr. 1 include acquisition and possession as well as trade, manufacture, placing on the market, cross-border movement and administering to another person; the offence in § 4 Abs. 1 is confined to trading, placing on the market and administering to another, together with manufacture or import for the purpose of placing on the market.
