Is CBD legal in Ireland?
- Legal status
- CBD (cannabidiol) is lawful only where derived from a non-controlled plant part with no THC content; THC is a controlled drug under the Misuse of Drugs Act 1977 with no permitted tolerance (except hemp seed), and ingestible CBD supplements are unauthorised Novel Foods.
- Consequences if caught
- CBD containing any THC, or extracted from a controlled plant part (even cold-pressed hemp oil), is a controlled drug under the MDA 1977; the FSAI has ordered withdrawals of unauthorised CBD supplements.
- If prescribed or medical
- Cannabidiol is available as the licensed medicine Epidyolex on prescription; distinct from cannabis, possession of which is criminal under the MDA 1977.
- Documentation
- Carry proof the CBD is THC-free and from a non-controlled plant part; a THC-containing product cannot be legalised by paperwork, and Epidyolex needs a prescription.
