Is CBD legal in Italy?
- Legal status
- CBD (cannabidiol) is legal only if extracted from the leaves, stems and seeds of certified industrial hemp; since Decree-Law No. 48/2025 (in force April 2025) hemp inflorescences ('cannabis light') and all their derivatives are classified as narcotics regardless of THC content.
- Consequences if caught
- CBD flower and inflorescence-derived products are now treated as narcotic substances under DPR 309/1990 as amended, while leaf/stem/seed-derived CBD below 0.2% THC remains lawful; an earlier 2023 Health-Ministry decree on CBD oral solutions had been suspended by TAR Lazio.
- If prescribed or medical
- Cannabidiol-based magistral preparations are available on prescription within the medical-cannabis framework; distinct from recreational cannabis, which remains illegal.
- Documentation
- Carry provenance documentation showing CBD is leaf/stem/seed-derived (not inflorescence) and below 0.2% THC; inflorescence-derived CBD cannot be legalised by paperwork, and magistral preparations need a prescription.
