Is Caffeine legal in Germany?
- Legal status
- Caffeine is absent from the German narcotics lists, and the dossier records the absence as a search that was actually run. On 20 September 2026 the terms „Koffein; Coffein; Caffeine“ were put to BtMG Anlagen I bis III and to NpSG Anlagen 1 und 2, and no entry was returned in either statute. The regime the dossier routes the substance to instead is food law, with the medicines statute available only on a condition it quotes: AMG § 2 reaches „Stoffe oder Zubereitungen aus Stoffen“ only where the purpose or the effect the provision specifies is present. So an ordinary caffeinated food or drink is a food, and a caffeine product becomes a medicines question only when it is presented or acts as one.
- Consequences if caught
- Capital exposure: none. Germany has no death penalty and nothing here comes close. There is also no narcotics ceiling, and the dossier is explicit about why: a confirmed absence from the lists yields no BtMG maximum, because there is no entry for a penalty to hang on. The exposure that exists is regulatory rather than criminal in the ordinary case, running to the composition and labelling of a particular product under food law, or to the authorisation requirement if the product crosses into medicines territory. Neither is a drug offence and neither is quantified by the dossier.
- If prescribed or medical
- There is no schedule placement, so there is no narcotics traveller rule to state. A caffeine product travels as a food or as a medicine according to what it is, and the dossier settles neither for any particular product; what it does settle is that the substance itself is in none of the five lists searched. No German prescription rule or traveller rule is recorded for this row, so the cell defers on both rather than constructing one.
- Documentation
- Nothing is required for the substance as such. Where a high-dose product is carried, its own labelling is the relevant record, because the only live classification question is the food or medicine line the dossier leaves to the product. The search was run on 20 September 2026.
- Germany, confirmed absence from Betäubungsmittelgesetz Anlagen I bis III and Neue-psychoaktive-Stoffe-Gesetz Anlagen 1 und 2 on the terms „Koffein
- Coffein
- Caffeine“, read at the Anlage pages on https://www.gesetze-im-internet.de/ on 20 September 2026
- the conditional medicines route quoted is AMG § 2, read at https://www.gesetze-im-internet.de/amg_1976/__2.html on 20 September 2026
