Legality · Peyote

Is Peyote legal in Germany?

Confirmed against a primary sourceVerified July 14, 2026
Legal status
Mescaline (Meskalin) is listed in Anlage I of the Narcotic Drugs Act (BtMG) as a non-tradable, non-prescribable narcotic; the peyote (Lophophora) cactus is not itself named, so control attaches to the isolated alkaloid rather than to the living plant.
Consequences if caught
Handling isolated mescaline is a BtMG offence; the intact peyote cactus is not scheduled by name, leaving the living plant a grey-zone ornamental.
If prescribed or medical
As an Anlage I substance mescaline is non-prescribable; peyote is not a licensed medicine.
Documentation
BtMG Anlage I lists "Mescalin (3,4,5-Trimethoxyphenethylazan)"; no entry names peyote, Lophophora or mescaline-containing cacti.
