Is Peyote legal in Germany?

Legal status

Peyote is a plant and the German narcotics table does not name it, so the row resolves through the alkaloid it contains. The dossier takes the route through mescaline and records the Anlage I row of the Betäubungsmittelgesetz as „- | Mescalin | 3,4,5-Trimethoxyphenethylazan“. The consequence of a plant route is that the cactus is reached to the extent that it carries the listed alkaloid, and it is worth noting what the German table does elsewhere for comparison: at least one plant in this set is named as a species with its plant parts in the same Anlage, so the absence of a species line here is a choice rather than an oversight. Placement is under BtMG § 1 Abs. 1 and the tier is Anlage I, the non-marketable one.

Consequences if caught

Capital exposure: none. The dossier's penalty column records that no death-penalty regime applies. The provisions are BtMG §§ 29 bis 30a and the recorded figure is the ceiling: not less than five years under § 30a Abs. 1, with a determinate sentence capped at fifteen years by StGB § 38 Abs. 2. No ordinary band is recorded here. On a constituent route the alkaloid content is what engages the entry, so a living ornamental plant, dried material and an extract are not automatically the same case, and the alkaloid actually present is what has to be established.

If prescribed or medical

Anlage I is the non-marketable tier of the three, read at gesetze-im-internet.de on 21 September 2026, so no German prescribing route exists for the alkaloid and therefore none for the plant that carries it. The dossier records no traveller rule and no exemption for ceremonial use or for horticultural specimens, so this cell states the constituent placement and defers explicitly on the documentation.
