Is Mescaline legal in Germany?

Listed by name in Anlage I of the Betäubungsmittelgesetz, the non-marketable tier. Mescaline holds its own line there. The printed row reads „- | Mescalin | 3,4,5-Trimethoxyphenethylazan“, with the German spelling in the second column and the trimethoxy phenethylamine in the third. The three methoxy groups at positions three, four and five are the whole of the identity, and they are what distinguish the alkaloid from the ring-substituted phenethylamines that Germany lists separately. Placement is under BtMG § 1 Abs. 1. The entry is direct and molecular, so the phenethylamine structure group in the new psychoactive substances statute is not the route and is not part of the consequences here.

Consequences if caught

Capital exposure: none. The dossier's penalty column records that no death-penalty regime applies. The penal provisions are BtMG §§ 29 bis 30a and the dossier gives the ceiling: not less than five years under § 30a Abs. 1, with the fifteen-year limit on a determinate sentence in StGB § 38 Abs. 2.
