Is Nitrous Oxide legal in Germany?

Legal status

Not a narcotic under the Betäubungsmittelgesetz, but restricted with an INTENT/consumer-protection element: nitrous oxide is brought under the handling prohibition of section 3 of the New Psychoactive Substances Act (NpSG) by the amending Act passed by the Bundestag on 13 November 2025 for cartridges holding more than 8.4 g, banning supply, acquisition and possession by minors and sale via vending machines and mail order, while ready-made whipped cream and legitimate technical/medical use stay permitted.

Consequences if caught

Administrative and criminal penalties under the NpSG apply to prohibited trade and supply to minors; purely legitimate food, technical or medical use is not penalised. No capital exposure (non-DP).

If prescribed or medical

Nitrous oxide remains an authorised medical anaesthetic gas and food additive (E942); genuine medical and culinary supply is unaffected by the NpSG restriction.

Documentation

Small food cartridges and whipped-cream products remain available; large recreational cylinders, mail-order and vending-machine sales to consumers are closed off, and numerous municipalities already ban public sale or supply of nitrous oxide to minors.
