Is Nitrous Oxide legal in Germany?

Legal status

Nitrous oxide is placed by the Neue-psychoaktive-Stoffe-Gesetz through a named line in Anlage 2, and the line carries its own quantitative limits on its face. An Anlage 2 line enters the Act through § 2 Nr. 1 Buchst. b, which is the limb for individually listed substances, and not through the Buchst. a route used for the Anlage 1 structure groups. Nothing here is a narcotics listing: no BtMG line is placed against this gas, and the substance is also a food additive with the number the printed row itself records.

Consequences if caught

Capital exposure: none. Germany has no death penalty. This row is the clearest case in the set for keeping the prohibition apart from the offence, because the thresholds sit in the listing rather than in the penalty. Under § 3 Abs. 1 Nr. 1 a listed Anlage 2 substance is caught only where it carries the properties set out in the third column of that Anlage, which is where the container and transaction limits recorded above live. Two further prohibitions attach to Anlage 2 substances specifically: § 3 Abs. 1 Nr. 2 over distance selling and vending-machine supply, and § 3 Abs. 1 Nr. 3 over supply to persons under eighteen, with Nr. 4 addressing acquisition and possession by a person under eighteen. The offence provision reaches none of that ground in full: § 4 Abs. 1 punishes contraventions of Nr. 1 and Nr. 2 only, and only where committed by trading, placing on the market, administering to another, or manufacture or import for the purpose of placing on the market. So the supply-to-minors prohibition and the under-eighteen possession prohibition are prohibitions that § 4 does not turn into an offence, and § 5 provides for forfeiture of objects to which a § 4 offence relates. If prescribed or medical

No narcotics tier applies, because the substance holds no BtMG Anlage placement, and the statute that does place it works by prohibition with exemptions for recognised commercial, industrial and scientific uses rather than by prescription. Medical and culinary uses of the gas therefore sit outside this row's subject matter rather than inside a prescribing route, and the dossier does not resolve how a particular medical or food supply is treated. It records no German traveller rule, so this cell defers on the border question.
