Is Nicotine legal in Germany?

Legal status

Nicotine is outside the German narcotics lists and is regulated by product legislation instead. The search ran on 20 September 2026 under „Nikotin; Nicotine“ across BtMG Anlagen I bis III and NpSG Anlagen 1 und 2 and returned no entry in either. The dossier routes the substance to the tobacco products statute, recording that its § 1 covers tobacco products and related products and that § 10 sets requirements for ingredients and emissions. The route is therefore product-shaped rather than substance-shaped: what a nicotine article is, a tobacco product, a related product such as a liquid, or a medicine, determines which rules apply to it, and the molecule itself is not the unit of control.

Consequences if caught

Capital exposure: none. Germany has no death penalty. No narcotics ceiling applies either, and the dossier states the reason structurally: a confirmed absence from the drug lists produces no BtMG maximum. The exposure that exists attaches to the ingredient and emission requirements of the product regime and to how articles are placed on the market, so it is a regulatory exposure falling on a manufacturer or a seller rather than a drug offence falling on a holder, and the dossier does not put a figure on it.

If prescribed or medical

There is no schedule placement, so no narcotics traveller rule arises. A nicotine replacement product may be a medicine and fall under the medicines regime, while a consumer article falls under the tobacco products statute, and the dossier names both routes without resolving which applies to a given article. It records no German prescription rule or traveller rule, so this cell defers on both.

Documentation

For a consumer product the labelling required by the product regime is the relevant record, and for a medicinal nicotine product it is the dispensing packaging. Neither is a narcotics document, because no narcotics entry exists. The search and the product provisions were read on 20 September 2026.
