Is Nicotine legal in Germany?

Legal status

Not a controlled drug. Nicotine is not named in any Anlage of the Betäubungsmittelgesetz and is not reached by the Neue-psychoaktive-Stoffe-Gesetz. It is regulated as a consumer product under German and European tobacco law, which was not read here.

Consequences if caught

The Anlagen were searched and the only matches on the string nicotin are 3,6-Dinicotinoylmorphin in Anlage I and 6-Nicotinoylcodein and 6-Nicotinoyldihydrocodein in Anlage II. Those are nicotinoyl esters of morphine and codeine and they are different molecules. § 1(2) of the Neue-psychoaktive-Stoffe-Gesetz provides that it does not apply to Betäubungsmittel within § 1(1) of the Betäubungsmittelgesetz, nor to medicinal products within the Arzneimittelgesetz, nor to veterinary medicines or medical devices. So the drug law is read first and the new psychoactive substances law reaches only what the drug law does not. There is therefore no Betäubungsmittelgesetz offence and no Neue-psychoaktive-Stoffe-Gesetz offence for nicotine. Age limits, advertising rules and the places where smoking and vaping are allowed are set by tobacco and consumer protection law, and this cell does not state them.
