Modafinil is not scheduled in Germany. The search ran on 20 September 2026 under „Modafinil“ across BtMG Anlagen I bis III and NpSG Anlagen 1 und 2 and returned no entry in either statute. The regime that governs is medicines law, and the dossier states its operative rule from AMG § 21 in the form that matters here: placing a finished medicinal product on the market presupposes its authorisation. That is a supply-side control, which is why the answer for this substance is about how a product reaches a person rather than about whether the molecule is listed, and it is a materially different position from a narcotics placement even though the practical availability looks similar.

Consequences if caught

Capital exposure: none. Germany has no death penalty. No narcotics maximum applies either: the dossier records a confirmed absence from the drug schedules and derives no BtMG ceiling from it. The exposure that exists is a medicines exposure, attaching to unauthorised placing on the market and to supply outside a prescription, so it falls on a supplier rather than on a patient holding a dispensed product. The dossier does not quantify it and no narcotics figure is borrowed here, because the narcotics statute is not the applicable one.

EU/Schengen travel: carry prescribed narcotics for up to 30 days with an Article 75 Schengen certificate, completed by your doctor and authenticated by the competent Land health authority (one certificate per drug).
