Is Methamphetamine legal in Germany?
Also known as: meth
- Legal status
- Methamphetamine sits in Anlage II of the Betäubungsmittelgesetz, the middle tier, and not in the first. The dossier records the row as „Metamfetamin | Methamphetamin | (2S)-N-Methyl-1-phenylpropan-2-amin“: the international non-proprietary spelling first, the German spelling second, and the third column drawn at the single S enantiomer rather than at the racemate. That is a sharper entry than the one for the demethylated parent, which is written at the racemic form, and the difference is the kind of thing an identification turns on. Placement is under BtMG § 1 Abs. 1. Anlage II is the marketable but not prescribable tier, so lawful handling is possible for permitted purposes while no prescription can issue.
- Consequences if caught
- Capital exposure: none. The dossier's penalty column records that no death-penalty regime applies. The penal provisions are BtMG §§ 29 bis 30a, with the ceiling at not less than five years under § 30a Abs. 1 and a determinate sentence capped at fifteen years by StGB § 38 Abs. 2. No ordinary band is recorded and none is stated here. Because the entry names one enantiomer, the analysis has real work to do: material answering that configuration is on this line, and a racemic or opposite-handed sample has to be matched to whichever provision actually reaches it rather than assumed into this one.
- If prescribed or medical
- Not a traveller medicine in this form; any prescribable narcotic must be carried under the narcotics travel certificate (see documentation).
- Documentation
- EU/Schengen travel: carry prescribed narcotics for up to 30 days with an Article 75 Schengen certificate, completed by your doctor and authenticated by the competent Land health authority (one certificate per drug). From outside Schengen: carry a multilingual doctor's certificate authenticated by your home-country health authority. Ordinary (non-narcotic) medicines: up to a 3-month personal supply.
- Germany, Betäubungsmittelgesetz, Anlage II, the table row „Metamfetamin | Methamphetamin | (2S)-N-Methyl-1-phenylpropan-2-amin“, placed by § 1 Abs. 1 with penal provisions at §§ 29 bis 30a
