Is Amphetamine legal in Germany?

Confirmed against a primary sourceVerified September 21, 2026
Legal status
Amphetamine is listed in Germany in the prescribable tier rather than the prohibited one, which is the fact most accounts of it get wrong. The dossier records the Anlage III row of the Betäubungsmittelgesetz as „Amfetamin | Amphetamin | (RS)-1-Phenylpropan-2-ylazan“: the international non-proprietary spelling first, the German spelling second, and the racemate in the third column. The racemic form is what the entry is drawn at, and that is the detail the whole family of nearby questions turns on, because a single enantiomer and a positional relative are separate lines elsewhere in the schedules. Placement is under BtMG § 1 Abs. 1 and the entry is direct, so no constituent or class inference is involved and the Neue-psychoaktive-Stoffe-Gesetz is not engaged.
Consequences if caught
Capital exposure: none. The dossier's penalty column records that no death-penalty regime applies in Germany. The penal provisions are BtMG §§ 29 bis 30a and the recorded figure is the ceiling: not less than five years under § 30a Abs. 1, with the fifteen-year limit on a determinate sentence in StGB § 38 Abs. 2. The dossier records no ordinary band and this cell does not supply one. Because the substance is in the prescribable tier, the offence is constituted by handling outside the lawful supply route rather than by the substance being forbidden, and street material is squarely outside that route.
If prescribed or medical
Available on a BtM-Rezept; Schengen Art. 75 certificate (authenticated by the Land health authority) for up to 30 days' personal supply.
Documentation
EU/Schengen travel: carry prescribed narcotics for up to 30 days with an Article 75 Schengen certificate, completed by your doctor and authenticated by the competent Land health authority (one certificate per drug). From outside Schengen: carry a multilingual doctor's certificate authenticated by your home-country health authority. Ordinary (non-narcotic) medicines: up to a 3-month personal supply.
