Is Gabapentin legal in Germany?

Gabapentin is not scheduled in Germany. The search ran on 20 September 2026 under „Gabapentin“ across BtMG Anlagen I bis III and NpSG Anlagen 1 und 2 and returned no entry in either statute. What governs instead is the authorisation regime for medicinal products, and the dossier quotes the operative rule from AMG § 21, under which finished medicinal products may in principle „nur in den Verkehr gebracht werden, wenn sie... zugelassen sind“, that is, placed on the market only if they are authorised. So the control on this substance is a marketing control on the product rather than a narcotics control on the molecule, and it bites on whoever places the medicine on the market.

Consequences if caught

Capital exposure: none. Germany has no death penalty. There is also no narcotics maximum, because the dossier's finding is a confirmed absence from the lists and no BtMG ceiling can be derived from a substance not being in them. The exposure that exists sits in medicines law and attaches to unauthorised placing on the market, so it reaches a supplier of unauthorised product rather than a patient holding a dispensed one, and the dossier does not quantify it.

There is no narcotics placement, so no narcotics traveller rule arises. The substance is a prescription medicine question governed by the authorisation regime the dossier quotes, and a traveller carrying an authorised product is carrying an ordinary medicine rather than a scheduled narcotic. The dossier records no German traveller rule for medicines either, so this cell states the absence from the schedules and defers on the border documentation.
