Is Gabapentin legal in Germany?

Legal status
Gabapentin is verschreibungspflichtig (prescription-only), not a controlled drug: it is named in Anlage 1 of the Arzneimittelverschreibungsverordnung (AMVV) and is absent from the schedules (Anlagen I-III) of the Betäubungsmittelgesetz (BtMG). Unlike the UK, Germany leaves gabapentin as an ordinary prescription medicine.
Consequences if caught
Gabapentin is not a Betäubungsmittel, so no BtMG possession or trafficking penalty applies; dispensing this prescription medicine without a valid prescription breaches the AMVV and Arzneimittelgesetz.
If prescribed or medical
Prescribed on an ordinary (non-narcotic) prescription for epilepsy and neuropathic pain; no BtM-Rezept is required.
Documentation
Gabapentin products (Neurontin and generics) are pharmacy-dispensed prescription medicines carried lawfully with a prescription; no narcotics-import formalities apply.
