Is Diazepam legal in Germany?
Also known as: valium
- Legal status
- Diazepam is a named narcotic in the prescribable tier of the German schedules. The dossier records the Anlage III row of the Betäubungsmittelgesetz as „Diazepam | - | 7-Chlor-1-methyl-5-phenyl-1,3-dihydro-2H-1,4-benzodiazepin-2-on“. The first column carries the international non-proprietary name, the second is empty, and the third gives the chlorinated benzodiazepinone identity that distinguishes it from the hydroxylated and nitro-substituted members listed nearby. Placement runs through BtMG § 1 Abs. 1 and the tier is Anlage III, the marketable and prescribable one, so the control operates by regulating supply rather than by prohibiting the substance. The structural benzodiazepine group in the new psychoactive substances statute is a separate regime and is not the basis of this row.
- Consequences if caught
- Capital exposure: none. The dossier's penalty column records that no death-penalty regime applies in Germany. The penal provisions are BtMG §§ 29 bis 30a and the dossier gives the ceiling only: not less than five years under § 30a Abs. 1, with the fifteen-year limit on a determinate sentence in StGB § 38 Abs. 2. No ordinary band is recorded and none is supplied here. The practical shape of the offence on a widely prescribed medicine is that it turns on provenance: the same tablets are lawful when dispensed against a prescription and an offence when they are not, and counterfeit tablets sold under this name are a separate identification question again.
- If prescribed or medical
- Prescribed as an Anlage III benzodiazepine; within the exemption an ordinary prescription suffices.
- Documentation
- Within the Schengen area carry the Article 75 CISA certificate; domestically carry the prescription.
- Germany, Betäubungsmittelgesetz, Anlage III, the table row „Diazepam | - | 7-Chlor-1-methyl-5-phenyl-1,3-dihydro-2H-1,4-benzodiazepin-2-on“, placed by § 1 Abs. 1 with penal provisions at §§ 29 bis 30a
