Is Etizolam legal in Germany?

Etizolam is a named narcotic in Germany, which is worth stating because it is not a benzodiazepine in the strict sense and several jurisdictions reach it only through analogue provisions. The dossier records the Anlage III row of the Betäubungsmittelgesetz as „Etizolam | - | 4-(2-Chlorphenyl)-2-ethyl-9-methyl-6H-thieno[3,2-f][1,2,4]triazolo[4,3-a][1,4]diazepin“, and the third column shows why the distinction exists: the fused ring system is a thienotriazolodiazepine, with a thiophene in place of the benzene ring. Germany has given it a line of its own rather than relying on a structural test. Placement is by BtMG § 1 Abs. 1 and the tier is Anlage III, the marketable and prescribable one, although the substance holds no German marketing authorisation of its own.

Consequences if caught

Capital exposure: none. The dossier's penalty column records that no death-penalty regime applies.
