Is Clonazepam legal in Germany?

Also known as: klonopin

Confirmed against a primary sourceVerified September 21, 2026
Legal status
Clonazepam is a named narcotic in the prescribable tier of the German schedules. The dossier records the Anlage III row of the Betäubungsmittelgesetz as „Clonazepam | - | 5-(2-Chlorphenyl)-7-nitro-1,3-dihydro-2H-1,4-benzodiazepin-2-on“. The third column fixes two substituents that do the identifying work, the chlorophenyl group at position five and the nitro group at position seven, which is what separates this anticonvulsant from the other benzodiazepines listed in the same Anlage. Placement is under BtMG § 1 Abs. 1 and the tier is Anlage III, the marketable and prescribable one. The entry is a direct listing, so the structural benzodiazepine group in the new psychoactive substances statute is not the route here and does not supply the consequences.
Consequences if caught
Capital exposure: none. The dossier's penalty column records that no death-penalty regime applies in Germany. The penal provisions named are BtMG §§ 29 bis 30a, and the dossier gives only the ceiling: not less than five years under § 30a Abs. 1, with a determinate sentence capped at fifteen years by StGB § 38 Abs. 2. No ordinary band is recorded and none is stated. On a prescribable narcotic the offence is the handling outside the authorised route, so tablets acquired without a prescription are an offence in the same substance that is entirely lawful when dispensed against one.
If prescribed or medical
Prescribed as an Anlage III benzodiazepine; within the exemption an ordinary prescription suffices.
Documentation
Within the Schengen area carry the Article 75 CISA certificate; domestically carry the prescription.
