Are Benzodiazepines legal in Germany?

Legal status

Four named benzodiazepines are narcotics under Anlage III of the Betäubungsmittelgesetz. Benzodiazepines resolve member by member in Germany and across two different statutes, which is why a single class answer would be wrong here. The check was run against Anlage III of the Betäubungsmittelgesetz and against NpSG Anlage 1 Nr. 3, and the printed narcotics entries are: „Alprazolam | - | 8-Chlor-1-methyl-6-phenyl-4H-[1,2,4]triazolo[4,3-a][1,4]benzodiazepin“; „Clonazepam | - | 5-(2-Chlorphenyl)-7-nitro-1,3-dihydro-2H-1,4-benzodiazepin-2-on“; „Diazepam | - | 7-Chlor-1-methyl-5-phenyl-1,3-dihydro-2H-1,4-benzodiazepin-2-on“; „Lorazepam | - | (RS)-7-Chlor-5-(2-chlorphenyl)-3-hydroxy-1,3-dihydro-2H-1,4-benzodiazepin-2-on“. A named medicine is answered by its own Anlage III line. An analogue that is not named is not caught by those lines at all and has to be put to the separate structural test in the new psychoactive substances statute, which is a different regime with a different prohibition and a different penalty.

Consequences if caught

Capital exposure: none. Germany has no death penalty, on either branch of this row. The two branches do not share a penalty and this cell does not merge them. For a member named in Anlage III the provisions are BtMG §§ 29 bis 30a, with the ceiling at not less than five years under § 30a Abs. 1 and a determinate sentence capped at fifteen years by StGB § 38 Abs. 2. For an unnamed analogue reached by NpSG Anlage 1 Nr. 3 the position is different in kind: the prohibition in § 3 Abs. 1 Nr. 1 covers acquisition and possession, while the offence in § 4 Abs. 1 covers only trading, placing on the market, administering to another, and manufacture or import for the purpose of placing on the market, so the listing produces a prohibition that does not by itself supply a penalty. The figure the dossier records on that side is § 4 Abs. 3, „Freiheitsstrafe von einem Jahr bis zu zehn Jahren“, the aggravated band, with up to three years or a fine for the ordinary offence. If prescribed or medical

Anlage III is prescribable. A prescribed benzodiazepine medicine carried with its prescription is lawful. A designer benzodiazepine has no authorised medicinal form and no prescription route.

Documentation

For a prescribed controlled medicine on Schengen travel, carry a Schengen certificate issued under article 75 of the Convention implementing the Schengen Agreement, together with the original packaging and the prescription.
