Is Crack Cocaine legal in Germany?
- Legal status
- Crack is the freebase (base) form of cocaine and has no separate legal identity in Germany: it is controlled AS cocaine, a narcotic (Betäubungsmittel) listed in Annex III to the Narcotic Drugs Act (BtMG), whose entry covers cocaine, its salts and any preparation containing it, thereby reaching the base/freebase form. Crack is thus handled identically to cocaine as a controlled narcotic.
- Consequences if caught
- Unauthorised possession, acquisition or trafficking of crack (as cocaine) is criminal under BtMG §29; possession up to 5 years, trafficking and larger quantities up to 15 years.
- If prescribed or medical
- Cocaine hydrochloride has narrow authorised medical use as a topical anaesthetic under BtMG prescribing controls; the crack/freebase form has no medicinal preparation and cannot be prescribed.
- Documentation
- Not a prescribable medicine in base form; no BtMG prescription or patient documentation exists for crack/freebase cocaine.
