Is Cocaine legal in Germany?

Cocaine is a named narcotic in Germany and it sits in the prescribable tier rather than the prohibited one. The dossier records the Anlage III row of the Betäubungsmittelgesetz as „- | Cocain (Benzoylecgoninmethylester) | Methyl[3ß-(benzoyloxy)tropan-2ß-carboxylat]“, which is the instrument's own German wording, with the German spelling and the ester synonym in the second column and the tropane ester identity in the third. The configuration is printed at both tropane positions, so the entry is drawn at a defined stereochemistry rather than at the ester generally. Placement is under BtMG § 1 Abs. 1. The tier is Anlage III, the marketable and prescribable one, which reflects the narrow medical use of the substance rather than any tolerance of it outside that use.

Consequences if caught

Capital exposure: none. The dossier's penalty column records that no death-penalty regime applies. The penal provisions are BtMG §§ 29 bis 30a and the dossier gives the ceiling: imprisonment of not less than five years under § 30a Abs. 1, with StGB § 38 Abs. 2 capping a determinate sentence at fifteen years.
