Is Ayahuasca legal in Germany?

Ayahuasca is a preparation and the German schedules do not list preparations by name, so this row is resolved through a constituent. The dossier takes the route through dimethyltryptamine and records the Anlage I row of the Betäubungsmittelgesetz as „- | N,N-Dimethyltryptamin (Dimethyltryptamin, DMT) | [2-(Indol-3-yl) ethyl]dimethyl-azan“. The consequence of the constituent route is precise: what is scheduled is the alkaloid, so the brew is reached to the extent that it contains that alkaloid, and the plant material itself is not separately named in the row relied on. Placement is under BtMG § 1 Abs. 1 and the tier is Anlage I, the non-marketable one. The Neue-psychoaktive-Stoffe-Gesetz tryptamine group is a separate regime and is not the basis of this result.

Consequences if caught

Capital exposure: none. The dossier's penalty column records that no death-penalty regime applies. The penal provisions are BtMG §§ 29 bis 30a, and the dossier gives the ceiling: not less than five years under § 30a Abs. 1, with a determinate sentence capped at fifteen years by StGB § 38 Abs. 2.
