Is PCP legal in Turkey?

Legal status

PCP is a controlled substance in Turkey and the dossier carries it under the schedule name pcp, a VERIFIED placement in the classification decisions made under article 19 of Law No. 2313 on the Control of Narcotic Substances. Phencyclidine was withdrawn from human and then veterinary medicine decades ago, so unlike ketamine it carries no current lawful supply chain in Turkey and the control is effectively a prohibition in practice. Article 19 reaches it as one of the poisons outside the 1933 article 1 list which scientific examination shows to be harmful and to produce toxicomania, determined and announced by the health ministry on a Presidential decision. PCP is not named in the article 188(4)(a) uplift list of Penal Code No. 5237.

Consequences if caught

Capital exposure: none. The cited instruments give no per-substance numeric quantity threshold; purpose and circumstances are assessed case by case, and the ceiling is 30 years under article 188(1) of Penal Code No. 5237, «yirmi yıldan otuz yıla kadar hapis ve ikibin günden yirmibin güne kadar adlî para cezası», for unlicensed manufacture, import or export. Because there is no licensed PCP production anywhere in the supply chain, any manufacture is unlicensed manufacture within that paragraph. Article 188(3) sets not less than ten years for domestic sale, supply, dispatch, transport, storage, purchase, acceptance and possession, and article 188(5) increases the sentence by one half where three or more people act together and doubles it for conduct within the activity of an organisation formed to commit crime. On the user side article 191(1) sets two to five years for buying, accepting or possessing for use and for use itself, with the five year deferral of 191(2), at least one year of denetimli serbestlik under 191(3) and treatment where it is thought necessary.

If prescribed or medical

There is no prescription route for PCP in Turkey. It has no marketed human or veterinary medicine, the dossier recorded no prescription instrument for this row, and no per-substance medical route is asserted here. Article 188(6) of the Penal Code extends the trafficking paragraphs to substances whose production is permission bound or whose sale is prescription bound and which produce a narcotic or stimulant effect, but a substance with no current authorised product falls outside the medicine facing part of that provision. A foreign prescription is not a Turkish authorisation and none exists to present.

No document makes PCP lawful to carry. The documentation risk on this row is contamination rather than intention, since phencyclidine turns up in material sold as other dissociatives or smoked on plant matter, and the charge follows the laboratory report obtained under article 20 of Law No. 2313 rather than the description given at the point of sale.
