Is Mitragynine legal in Germany?

- Neither mitragynine nor kratom is separately scheduled in Germany: mitragynine, the principal alkaloid of kratom, is neither a Narcotics Act (BtMG) substance nor within the NpSG substance groups, so as a kratom alkaloid it shares the plant's un-controlled status — reachable only through the Medicines Act (AMG), under which unlicensed commercial sale for human consumption has been barred (OLG Koln, 2025).
- Consequences if caught
- No controlled-substance penalty attaches to the alkaloid; unlicensed commercial sale of kratom is restrained under medicines law (AMG), not the BtMG.
- If prescribed or medical
- No licensed kratom or alkaloid medicine exists in Germany; there is no ordinary prescription product.
- Documentation
- No narcotics import licence applies; personal carry is limited only by medicines-law restrictions on unlicensed products.
