- Kratom (Mitragyna speciosa) is not controlled in Germany — it is not scheduled under the Narcotics Act (BtMG) nor the New Psychoactive Substances Act (NpSG), and neither mitragynine nor 7-hydroxymitragynine is a BtMG/NpSG substance. It is reachable only through medicines law: commercial sale is restricted under the Medicines Act (AMG), and the OLG Koln (2025) barred unlicensed commercial sale for human consumption.

- No drug-law penalty for personal possession; unlicensed commercial sale for human consumption can be restrained or penalised under the Medicines Act (AMG).
- If prescribed or medical
- Not a scheduled medicine — there is no BtM prescription requirement; kratom is handled under medicines and consumer law rather than narcotics control.
- Documentation
- Personal possession is not a narcotics offence; carry a reasonable personal quantity, noting it may not be lawfully sold for human consumption.
