Is Methamphetamine legal in Turkey?

Methamphetamine is a controlled substance in Turkey and the dossier carries it under the schedule name methamphetamine, a VERIFIED placement in the classification decisions made under article 19 of Law No. 2313 on the Control of Narcotic Substances. A second question sits beside the placement and the dossier does not answer it. Article 188(4)(a) of Penal Code No. 5237 raises the sentence where the material is «amfetamin ve türevleri», amphetamine and its derivatives, a limb inserted by Law No. 7445 of 28 March 2023. Methamphetamine is the N-methyl homologue of amphetamine, so reading it into that limb is the natural construction, but it is a construction and not a word in the statute, and the dossier made no finding on it. State the placement as verified and the uplift as the likely reading.

Consequences if caught

Capital exposure: none. The cited instruments give no per-substance numeric quantity threshold; purpose and circumstances are assessed case by case, and the ceiling is 30 years under article 188(1) of Penal Code No. 5237, «yirmi yıldan otuz yıla kadar hapis ve ikibin günden yirmibin güne kadar adlî para cezası», for unlicensed manufacture, import or export. The domestic floor in article 188(3) is not less than ten years for sale, offer for sale, supply, dispatch, transport, storage, purchase, acceptance and possession, and fifteen years where the person supplied is a child. If the court reads methamphetamine into the amphetamine derivatives limb of 188(4)(a), the sentence is then increased by one half; if it does not, the 188(4)(b) proximity limb and the 188(5) plurality and organisation limbs still reach the ordinary trafficking case, the second of which doubles the sentence where the conduct falls within the activity of an organisation formed to commit crime. Article 191(1) sets two to five years for buying, accepting or possessing for use and for use itself, with the five year deferral of 191(2) and at least one year of denetimli serbestlik under 191(3).

If prescribed or medical

There is no traveller prescription route for methamphetamine in Turkey. It is not a marketed Turkish medicine and the dossier recorded no prescription instrument for this row, so no medical route is asserted here. The country level rule that does apply is article 24 of Law No. 2313, under which a pharmacy that sells a narcotic substance without a physician's prescription is punished under the relevant articles of the Penal Code, and article 188(6) of the Code, which extends the trafficking paragraphs to substances that are permission bound or prescription bound and produce a narcotic or stimulant effect. A traveller prescribed a different stimulant should settle that specific product with the TİTCK rather than reason from this row.

Documentation

No document makes methamphetamine lawful to carry, and the practical documentation risk on this row is misidentification of a lawfully prescribed stimulant at the border. Carry any prescribed stimulant in its original dispensing packaging with the prescription and a prescriber's letter naming the patient, the active ingredient, the dose and the treatment period, so that the product can be identified without a laboratory.
