Is Methadone legal in Germany?

Methadone is a named narcotic in the prescribable tier of the German schedules. The dossier records the Anlage III row of the Betäubungsmittelgesetz as „Methadon | - | (RS)-6-Dimethylamino-4,4-diphenylheptan-3-on“. The third column fixes the racemate, and that detail is not decorative on this substance: the single laevorotatory enantiomer is dispensed in Germany as a separate treatment preparation, and an entry drawn at the racemate is drawn at the mixture rather than at that isolate. Placement is under BtMG § 1 Abs. 1 and the tier is Anlage III, the marketable and prescribable one, which is what allows substitution treatment to operate inside the narcotics regime rather than outside it.

Consequences if caught

Capital exposure: none. The dossier's penalty column records that no death-penalty regime applies. The provisions are BtMG §§ 29 bis 30a and the dossier records the ceiling: not less than five years under § 30a Abs. 1, with a determinate sentence capped at fifteen years by StGB § 38 Abs. 2. No ordinary band is recorded and none is stated. On a substitution medicine the offence is defined by departure from the authorised route, so material passed on to another person is outside it even where the original dispensing was entirely lawful.
