Is Buprenorphine legal in Germany?

Buprenorphine is a named narcotic in the prescribable tier of the German schedules. The dossier records the Anlage III row of the Betäubungsmittelgesetz as „Buprenorphin | - | (5R,6R,7R,14S)-17-Cyclopropyl-methyl-4,5-epoxy-7-[(S)-2-hydroxy-3,3-dimethylbutan-2-yl]-6-methoxy-6,14-ethanomorphinan-3-ol“. The third column is unusually specific even for this table: four ring stereocentres are fixed and the side chain carries its own configuration, so the entry is drawn at one defined stereoisomer of a semisynthetic morphinan rather than at a family. Placement is under BtMG § 1 Abs. 1. The tier is Anlage III, the marketable and prescribable one, which is consistent with the substance being a treatment medicine rather than a prohibited compound.

Consequences if caught

Capital exposure: none. The dossier's penalty column records that no death-penalty regime applies in Germany. The penal provisions named are BtMG §§ 29 bis 30a and the dossier records the ceiling alone: not less than five years under § 30a Abs. 1, with a determinate sentence capped at fifteen years by StGB § 38 Abs. 2. No ordinary band is recorded and none is invented here. Because the substance is prescribable, the offence is the handling outside the lawful route, so diverted treatment medication is on the same footing as any other unauthorised narcotic handling and the fact that it is a treatment drug does not answer the charge.

Prescribed for opioid substitution mainly by office-based GPs with pharmacy dispensing (take-home permitted), on a narcotics prescription (BtM-Rezept).
