Is Fentanyl legal in Germany?

Also known as: fent

Confirmed against a primary sourceVerified September 21, 2026
Legal status
Fentanyl is a named narcotic in the prescribable tier of the German schedules. The dossier records the Anlage III row of the Betäubungsmittelgesetz as „Fentanyl | - | N-(1-Phenethyl-4-piperidyl)-N-phenylpropanamid“. The third column describes the parent anilidopiperidine, and the precision of that description is the legally important part: the analogues that differ at the acyl group or on the piperidine ring are not this molecule, and they are reached, if at all, by their own entries rather than by this one. Placement is under BtMG § 1 Abs. 1 and the tier is Anlage III, the marketable and prescribable one, which reflects the substance's established clinical use in anaesthesia and pain management.
Consequences if caught
Capital exposure: none. The dossier's penalty column records that no death-penalty regime applies in Germany. The penal provisions are BtMG §§ 29 bis 30a, and the dossier records the ceiling alone: not less than five years under § 30a Abs. 1, with a determinate sentence capped at fifteen years by StGB § 38 Abs. 2. No ordinary band is recorded and none is stated here. The identification point carries unusual weight on this substance, because material sold on the street under this name is frequently a different analogue, and the German table answers each analogue by its own line rather than by treating the family as one entry.
If prescribed or medical
Anlage III is prescribable. A medicine containing it may be prescribed in Germany, and a prescribed medicine carried with its prescription is lawful. For controlled medicines on Schengen travel see documentation.
Documentation
For a prescribed controlled medicine on Schengen travel, carry a Schengen certificate issued under article 75 of the Convention implementing the Schengen Agreement, together with the original packaging and the prescription.
