Is MDMA legal in Turkey?

Also known as: molly, ecstasy

Confirmed against a primary sourceVerified September 20, 2026
Legal status
MDMA is a controlled substance in Turkey and the dossier carries it under the schedule name mdma, a VERIFIED placement in the classification decisions made under article 19 of Law No. 2313 on the Control of Narcotic Substances. Article 19 is the route by which a substance outside the 1933 statute's own article 1 list is brought under the Law, on a Presidential decision announced by the health ministry, and the consolidated text footnotes ten such decisions between 22 May 2013 and Presidential Decision No. 10851 of 9 January 2026 without reproducing their annexed substance lists. Separately, article 188(4)(a) of Penal Code No. 5237 raises the sentence where the material is «amfetamin ve türevleri», amphetamine and its derivatives. MDMA is 3,4-methylenedioxymethamphetamine and reading it into that limb is the natural construction, but the limb names the parent class and not this molecule, and the dossier made no finding on it.
Consequences if caught
Capital exposure: none. The cited instruments give no per-substance numeric quantity threshold; purpose and circumstances are assessed case by case, and the ceiling is 30 years under article 188(1) of Penal Code No. 5237, with aggravating multipliers in article 188(4), (5) and (8). Article 188(3) puts the floor for selling, offering for sale, giving to another, dispatching, transporting, storing, purchasing, accepting and possessing at not less than ten years, and at not less than fifteen where the person given or sold the substance is a child, a limb that bites directly on pill supply in a nightlife setting. Article 188(4)(b) adds a half increase where the conduct occurs in a public or publicly accessible place within two hundred metres of a school, dormitory, hospital, barracks or place of worship, and 188(5) adds a further half where three or more people act together. Because MDMA is carried in counted units, the trafficking and use line is drawn on circumstances rather than on a gram figure: article 191(1) sets two to five years for buying, accepting or possessing for use, with the five year deferral of 191(2) and at least a year of denetimli serbestlik under 191(3), and 191(7) ends the deferral in a decision of no grounds for prosecution where the conditions were kept.
If prescribed or medical
There is no prescription route for MDMA in Turkey. It has no marketed Turkish medicine and the dossier recorded no prescription instrument for this row, so nothing here rests on a medical claim and clinical trial access abroad does not transfer. Article 188(6) of the Penal Code extends the trafficking paragraphs to substances whose production is permission bound or whose sale is prescription bound and which produce a narcotic or stimulant effect, but a substance already carried in the classification decisions does not depend on that extension. A foreign prescription is not a Turkish authorisation.
Documentation
No document makes MDMA lawful to carry, and pressed tablets carry a second risk this row cannot quantify: the material actually present may be a different scheduled substance, and the charge follows the laboratory report obtained under article 20 of Law No. 2313, which requires a sample sufficient for analysis to be taken from any seized narcotic substance. The schedule name was read in the dossier on 18 September 2026 and articles 188(3), 188(4) and 191 were read from the consolidated Penal Code on 20 September 2026.
