Is HHC legal in Poland?

Legal status

Controlled, and the group changed on 28 July 2026. «HHC» is entry lp. 83 in group II-P of Załącznik nr 1, the psychotropic annex, with the alternative name Heksahydrokannabinol, added by the amending regulation of 7 July 2026, Dz.U. 2026 poz. 934. The same regulation repealed the earlier entry at lp. 99 of group I-P, so the substance moved from the research-only psychotropic tier to the tier that article 33(1) allows to be used medically. The published Poland entry places HHC in group I-N, the narcotic annex. That is wrong on both texts read here: it was group I-P and it is now group II-P.

Consequences if caught

Capital exposure: none. Poland has no death penalty, and the heaviest band the 2005 Act reaches for any conduct with this substance is a term of years. Possession is an offence under article 62(1) of the 2005 Act and the band there is up to three years. Where the quantity is considerable, article 62(2) sets a band of one year to ten years. In a case of lesser gravity article 62(3) provides instead for a fine, a restriction of liberty or up to one year. Article 62a lets proceedings be discontinued, even before the decision to open an investigation, where the quantity is insignificant and intended for the holder's own use and a penalty would be inexpedient. That is a power of the prosecutor and not an entitlement of the holder, so it is not decriminalisation. The acetate «HHC-O» remains at lp. 100 of group I-P and did not move with it, so two members of one family now sit in different tiers. The heptyl homologue «HHCP» is on the third annex at lp. 60 instead, where article 62b applies rather than article 62. Supply offences sit apart from possession. Article 56 punishes putting such a substance on the market with a fine and six months to eight years, and article 56(3) raises that to a fine and two years to twelve years where the quantity is considerable. Article 59(1) punishes supply for gain with one year to ten years. The published Poland entry records a first listing by Minister of Health regulation in force 17 July 2023, Dz.U. 2023 poz. 744, and a Commission on Narcotic Drugs placement in Schedule II of the 1971 Convention in force 6 December 2025. If prescribed or medical

No authorised medicinal product in Poland contains it, although the move to group II-P permits one in principle under article 33(1).

Documentation

No personal import route exists, because a listed substance may be brought in only under the licensing chapter of the 2005 Act and not on a traveller's own account. The certificate issued under article 75 of the Convention implementing the Schengen Agreement is the route for a prescribed controlled medicine and does not reach a substance for which no prescription can be written. Vape and flower products sold under this name circulated widely before the listings, and the entry that governs them now is group II-P.
