Is DXM legal in Switzerland?

Not controlled, and by an express exclusion rather than by silence. Annex 2, list a of BetmVV-EDI states „Dextromethorphan untersteht nicht der Kontrolle.“, that dextromethorphan is not subject to control. That is a stronger result than a failed search: the ordinance has considered the substance and put it outside the controlled set, so the article 1(2) extensions for salts, esters, ethers, carbamates, stereoisomers and preparations have nothing to attach to. Medicines law still governs how a dextromethorphan preparation is sold and supplied.

Consequences if caught

Capital exposure: none. Switzerland has no death penalty, and no BetmG article 19 ceiling attaches to dextromethorphan either, because the ordinance expressly excludes it: Annex 2, list a of BetmVV-EDI states „Dextromethorphan untersteht nicht der Kontrolle.“, and the drug act's offence articles operate only on controlled substances. Neither the aggravated forms in article 19(2) nor the 20 year maximum in StGB article 40 is engaged by the substance itself, and the article 1(2) extensions have nothing to attach to. What remains is ordinary medicines and product law, together with the general criminal law where separate conduct such as driving under the influence is in issue.

If prescribed or medical

Dextromethorphan sits outside lists a to e by an express exclusion, so there is no controlled substance authorisation to carry for it. The country level rule this dossier establishes is the personal use regime of BetmG articles 19a and 19b, whose only stated quantity is the 10 g of cannabis fixed by article 19b(2), and none of it reaches an expressly excluded substance. Whether a particular cough preparation is prescription only or sold over the counter is a medicines law question that this dossier did not settle.

Documentation

Carry a dextromethorphan preparation in its original packaging with the pharmacy labelling, since the exclusion is written against the substance and the packaging is what identifies the product. The provenance is the express exclusion at Annex 2, list a of BetmVV-EDI in the German consolidation dated 13 March 2026, read at Fedlex on 18 September 2026, where the text reads „Dextromethorphan untersteht nicht der Kontrolle.“ and no other list carries the substance.
