Is Delta-8-THC legal in Malaysia?

Confirmed against a primary sourceVerified July 14, 2026
Legal status
Controlled — delta-8-THC (Δ8-THC) is caught as a tetrahydrocannabinol under the Dangerous Drugs Act 1952 (First Schedule), which schedules tetrahydrocannabinols; delta-8 is controlled as an isomer of THC. Distinct from cannabis; s.39B trafficking is death-eligible (discretionary since 2018) once statutory trafficking quantities are met, but those presumptions are plant-form/weight specific (cannabis 200 g), so the capital reach of a pure delta-8 tetrahydrocannabinol is left to confirmation.
Consequences if caught
Zero tolerance; possession and dealing penalties with caning; trafficking of scheduled dangerous drugs is capital-eligible above statutory thresholds.
If prescribed or medical
No recognised medical use; delta-8-THC is not a prescribable medicine.
Documentation
No lawful personal import of a scheduled dangerous drug.
