Is Tramadol legal in Turkey?

Tramadol is a controlled substance in Turkey and the dossier carries it under the schedule name tramadol, a VERIFIED placement in the classification decisions made under article 19 of Law No. 2313 on the Control of Narcotic Substances. That placement is the notable fact on this row, because tramadol is not scheduled under the international conventions and is treated as an ordinary prescription analgesic in a number of countries a traveller may be arriving from. Turkey's article 19 mechanism does not depend on convention listing at all: it reaches any poison outside the 1933 statute's article 1 list which scientific examination shows to be harmful and to produce toxicomania, once a Presidential decision so determines. Whether the «sentetik opioid ve türevleri» limb of article 188(4)(a) of Penal Code No. 5237 is read onto an atypical opioid such as tramadol is a separate question the statute does not answer and the dossier did not address.

Consequences if caught

Capital exposure: none. The cited instruments give no per-substance numeric quantity threshold; purpose and circumstances are assessed case by case, and the ceiling is 30 years under article 188(1) of Penal Code No. 5237, with aggravating multipliers in article 188(4), (5) and (8). The exposure that actually arises on this row is possession rather than importation, because a traveller may hold a quantity of tramadol that was dispensed lawfully elsewhere, and article 188(3) lists «satın alan, kabul eden, bulunduran», purchasing, accepting and possessing, beside selling, at a floor of not less than ten years for holding without licence or contrary to licence. Article 191(1) offers the lower route at two to five years where the holding is for the person's own use, with the five year deferral of 191(2), at least a year of denetimli serbestlik under 191(3) and a decision of no grounds for prosecution under 191(7) if the conditions are kept. Which of the two applies is decided on the circumstances, and documentation is the main thing a traveller controls.

If prescribed or medical

Tramadol is a prescription medicine in Turkey and a controlled one, and the mismatch with its status elsewhere is the trap. Article 24 of Law No. 2313 punishes a pharmacy owner or responsible manager who sells a narcotic substance without a physician's prescription under the relevant articles of the Penal Code, and article 188(6) of the Penal Code extends the trafficking paragraphs to any substance whose sale depends on a prescription written by an authorised physician and which produces a narcotic or stimulant effect, adding that the sentence may be reduced by up to half.
