Is Heroin legal in Turkey?

Also known as: diacetylmorphine, smack

Confirmed against a primary sourceVerified September 20, 2026
Legal status
Heroin is a controlled substance in Turkey and the dossier carries it under the schedule name «eroin». It is one of the four substances the Turkish Penal Code No. 5237 names in its own text rather than leaving to a classification decision: article 188(4)(a) opens «Yukarıdaki fıkralarda belirtilen uyuşturucu veya uyarıcı maddelerin eroin, kokain, morfin, bazmorfin, sentetik kannabinoid ve türevleri, sentetik katinon ve türevleri, sentetik opioid ve türevleri veya amfetamin ve türevleri olması», so eroin appears verbatim in the Code. That naming is a sentencing rule and not a schedule entry, and the schedule side runs through Law No. 2313 on the Control of Narcotic Substances and the classification decisions made under its article 19. The dossier's outcome for this row is VERIFIED on the schedule name alone; the article text quoted here was read from the consolidated statute on 20 September 2026 and is not in the dossier.
Consequences if caught
Capital exposure: none. No article in this chain carries a capital or whole life route, and the ceiling is the term in article 188(1) of Penal Code No. 5237, «yirmi yıldan otuz yıla kadar hapis ve ikibin günden yirmibin güne kadar adlî para cezası ile cezalandırılır», twenty to thirty years and a judicial fine of two thousand to twenty thousand days for unlicensed manufacture, import or export. Because heroin is named in article 188(4)(a), that ceiling is reached from a raised base: the paragraph closes «hâlinde verilecek ceza yarı oranında artırılır», the sentence to be imposed is increased by one half. Article 188(3) puts the floor for domestic sale, supply, dispatch, transport, storage, purchase, acceptance and possession at «on yıldan az olmamak üzere hapis», not less than ten years, and at fifteen years where the recipient is a child, and the half increase applies on top of that floor. Article 188(5) adds a further half where three or more people act together and doubles the sentence where the conduct is within the activity of an organisation formed to commit crime, which is the ordinary shape of a heroin case on the Turkish transit route. Article 191(1) sets two to five years for buying, accepting or possessing for use and for use itself, with the five year deferral and the denetimli serbestlik supervision of 191(2) and 191(3) available on the user side.
If prescribed or medical
There is no traveller prescription route for heroin in Turkey. Diamorphine is not a marketed Turkish medicine and the dossier recorded no prescription instrument for this row, so nothing here rests on a medical claim. The country level rule that does apply is article 24 of Law No. 2313, which provides that pharmacy owners and responsible managers who sell narcotic substances «tabip reçetesi olmadan», without a physician's prescription, are punished under the relevant articles of the Penal Code. Article 188(6) of the Code extends the trafficking paragraphs to substances whose production is permission bound or whose sale is prescription bound and which produce a narcotic or stimulant effect, but heroin already sits inside the named list and does not need that extension. A foreign prescription is not a Turkish authorisation.
Documentation
No document makes heroin lawful to carry into or through Turkey, and the opioid substitution question is separate from the traveller question. A traveller on a lawfully prescribed opioid should carry the original dispensing packaging, the prescription and a prescriber's letter naming the patient, the active ingredient, the dose and the treatment period, and should settle that specific product with the TİTCK before travelling. The schedule name «eroin» was read in the dossier on 18 September 2026 and article 188(4)(a) was read from the consolidated Penal Code on 20 September 2026.
