Is Fentanyl legal in Turkey?

- Fentanyl is a controlled substance in Turkey and the dossier carries it under the schedule name fentanyl, a VERIFIED placement in the classification decisions made under article 19 of Law No. 2313 on the Control of Narcotic Substances. Article 19 is the mechanism that reaches a molecule of this age, since the 1933 statute's own article 1 names only the opium and coca substances known at the time: it provides that poisons outside article 1 which scientific examination shows to be harmful and to produce toxicomania are brought under the Law «Cumhurbaşkanı karariyle», by Presidential decision, announced by the health ministry. Penal Code No. 5237 also raises the sentence where the material is «sentetik opioid ve türevleri», synthetic opioids and their derivatives, a limb inserted into article 188(4)(a) by Law No. 7445 of 28 March 2023. Fentanyl is the reference synthetic opioid, so that limb plainly bears on this row, but the statute names the class rather than the molecule and the dossier made no finding on the point.
- Consequences if caught
- Capital exposure: none. The cited instruments give no per-substance numeric quantity threshold; purpose and circumstances are assessed case by case, and the ceiling is 30 years under article 188(1) of Penal Code No. 5237, with aggravating multipliers in article 188(4), (5) and (8). The unlicensed manufacture, import or export band is «yirmi yıldan otuz yıla kadar hapis ve ikibin günden yirmibin güne kadar adlî para cezası», and the domestic conduct floor in 188(3) is not less than ten years. Where the synthetic opioid limb of 188(4)(a) is applied, the sentence is increased by one half. Article 188(8) matters more on this row than on most, because fentanyl diversion in Turkey runs through clinical supply rather than through import: where the offence is committed by a physician, dentist, pharmacist, chemist, veterinarian, health officer, laboratory technician, midwife, nurse, dental technician, orderly, health service provider or a person trading in chemicals or pharmaceuticals, the sentence is increased by one half. Article 191(1) sets two to five years on the user side, and article 192(4) provides that a user who applies to the authorities or to a health institution for treatment before an investigation has begun «cezaya hükmolunmaz», is not sentenced.
- If prescribed or medical
- A lawful medical route exists and it is narrow. Fentanyl is a hospital and severe pain medicine dispensed under prescription control, article 7 of Law No. 2313 confines the domestic sale of narcotic substances to licensed pharmacists and pharmaceutical traders, and article 24 of the same Law punishes a pharmacy that sells one without a physician's prescription under the relevant articles of the Penal Code. Article 188(6) of the Penal Code extends the trafficking paragraphs to any substance whose sale depends on a prescription written by an authorised physician and which produces a narcotic or stimulant effect, while allowing the sentence to be reduced by up to half; the dossier made no finding on either limb for this row. A transdermal patch is a controlled narcotic in the same way a vial is, and a foreign prescription does not authorise either in Turkey.

- A fentanyl patch is the single most misjudged item in a traveller's medicine bag, because it does not look like a controlled drug and used patches still contain active substance. Carry the original dispensing packaging with the prescription and a prescriber's letter naming the patient, the active ingredient, the patch strength, the dose and the treatment period, bring only the quantity the treatment period needs, and settle the product with the TİTCK before travelling. The schedule name was read in the dossier on 18 September 2026 and article 188(4)(a) with its 2023 amendment was read from the consolidated Penal Code on 20 September 2026.
