Is Psilocybin legal in Turkey?

- Psilocybin is a controlled substance in Turkey and the dossier carries it under the schedule name psilocybin, a VERIFIED placement in the classification decisions made under article 19 of Law No. 2313 on the Control of Narcotic Substances. The entry is for the alkaloid. Turkish law has no general clause carrying a scheduled compound across to fungal material or to esters of it, and the dossier's own neighbouring work shows that gap being applied rather than assumed: 4-AcO-DMT was searched and the near match psilocybin was rejected «because the acetate ester is not psilocybin», and 4-HO-MET was rejected against psilocin on the same principle. Amanita muscaria, a fungus with an entirely different chemistry, was separately searched and verified absent from the closed list. So the correct statement of this row is narrow: the alkaloid is scheduled, and each related material stands or falls on its own entry.
- Consequences if caught
- Capital exposure: none. The cited instruments give no per-substance numeric quantity threshold; purpose and circumstances are assessed case by case, and the ceiling is 30 years under article 188(1) of Penal Code No. 5237. Article 188(3) sets not less than ten years for domestic sale, supply, dispatch, transport, storage, purchase, acceptance and possession, and there is no cultivation offence for fungi corresponding to the hemp growing offence in article 23 of Law No. 2313, so conduct that would be charged as cultivation for cannabis is charged, if at all, through the manufacture limb of 188(1) or the possession limb of 188(3). On the user side article 191(1) sets two to five years, article 191(2) requires the prosecution to be deferred for five years, and article 191(4) lists what ends the deferral: persisting in breach of the imposed obligations or of the requirements of treatment, buying, accepting or possessing again for use, or using again. Article 191(7) closes the deferral with a decision of no grounds for prosecution where none of those occurred.

- There is no prescription route for psilocybin in Turkey. It has no marketed Turkish medicine, the dossier recorded no prescription instrument for this row, and clinical trial participation abroad confers nothing at the Turkish border. Article 188(6) of the Penal Code extends the trafficking paragraphs to substances that are permission bound or prescription bound and produce a narcotic or stimulant effect, while allowing the sentence to be reduced by up to half, but a substance carried by name in the classification decisions does not depend on that route. No per-substance medical route is asserted here.

- No document makes psilocybin lawful to carry, and dried fungal material is the commonest way this row is encountered rather than the pure alkaloid. Article 20 of Law No. 2313 requires a sample sufficient for analysis to be taken from any seized narcotic substance, so material asserted to be a culinary or ornamental mushroom is resolved by the laboratory report. Spores, grow kits and mycelium are not addressed in either instrument the dossier read and nothing here should be taken as permission for them. The schedule name was read in the dossier on 18 September 2026 and articles 188(3) and 191 were read from the consolidated Penal Code on 20 September 2026.
