Is Poppers legal in Turkey?

Legal status

Poppers is a product label covering a range of alkyl nitrites and not a single chemical, so it cannot receive one substance wide answer and the legal result follows the identified constituents of the tested product. The dossier states it as «“poppers” tek bir kimyasal madde değildir; her bileşen ayrı sınıflandırılır.», poppers is not one chemical and each constituent is classified separately. On the narcotics side the constituent this corpus does resolve points one way: amyl nitrite was searched by name, by its common synonyms and by its chemical name across the decisions made under article 19 of Law No. 2313 on the Control of Narcotic Substances and was verified absent from the closed list. Absence from the narcotics list is not permission, and it does not answer the separate questions of what a bottle in fact contains or which product law governs its sale, neither of which the dossier resolved.

Consequences if caught

Capital exposure: none. No article in this chain carries a capital or whole life route, and capital, life, quantity and ceiling consequences are assigned constituent by constituent rather than from the product label. For a constituent absent from the narcotics list, articles 188 and 191 of Penal Code No. 5237 do not engage at all, so the thirty year ceiling and the two to five year use offence are not in play. Two other provisions of the Penal Code can be, and they are of a different order entirely. Article 193 sets two months to one year for a person who without permission produces, possesses, sells or transports a substance containing poison whose production, possession or sale is subject to permission. Article 194 sets six months to one year for a person who gives or offers for consumption substances capable of creating a danger to health «çocuklara, akıl hastalarına veya uçucu madde kullananlara», to children, to the mentally ill or to users of volatile substances, which is the provision that most directly reaches supply of an inhalant. Whether either applies to a particular alkyl nitrite product was not established by the dossier.

If prescribed or medical

There is no prescription route and none is needed for a substance the narcotics list does not reach. Amyl nitrite has a historical clinical use as an antidote and in cardiology, but the dossier recorded no prescription instrument for this row and made no finding on any current Turkish authorisation, so no medical route is asserted here. The classification of any particular product, including whether it is sold as a cosmetic, a room odouriser or a chemical, is for the Turkish regulators to state and is deferred. Absence from the narcotics schedule tells a traveller nothing about import rules for the product as sold.
