Is Opium legal in Turkey?

Legal status

Opium is a controlled substance in Turkey and the dossier carries it under the schedule name «afyon». The 1933 statute splits it in two. Article 1 of Law No. 2313 on the Control of Narcotic Substances places «Tıbbi afyon ile müstahzaratının», medicinal opium and its preparations, under the supervision of the health ministry for import, export and domestic sale, while article 2 flatly prohibits the other kind: «2108 numaralı kanuna merbut afyon mukavelenamesinde tarif edilen ve müstahzar afyon namı verilen maddenin ihzar, ithal, ihraç ve satışı memnudur», the preparation, import, export and sale of the substance known as prepared opium, as defined in the opium convention annexed to Law No. 2108, is forbidden. Article 12 adds that the import of raw opium into Turkey is forbidden outside the terms of treaties the State has concluded. Turkey is itself a licensed producer of medicinal opium under the Toprak Mahsulleri Ofisi regime, which is why the control and prohibition limbs are separated in the statute. Consequences if caught

Capital exposure: none. The ceiling is 30 years under article 188(1) of Penal Code No. 5237, «yirmi yıldan otuz yıla kadar hapis ve ikibin günden yirmibin güne kadar adlî para cezası», for unlicensed manufacture, import or export, with aggravating multipliers in article 188(4), (5) and (8). Opium is not itself named in the article 188(4)(a) uplift list, although morphine and base morphine derived from it are, so the uplift reaches an opium case through what the material is found to contain rather than through the word afyon. The domestic floor in article 188(3) is not less than ten years for sale, supply, dispatch, transport, storage, purchase, acceptance and possession. Article 22 of Law No. 2313 adds a seizure rule specific to the prohibited forms: prepared opium and esrar «her nerede görülürse görülsün hemen zaptolunur», are seized immediately wherever they are found. On the user side article 191(1) sets two to five years with the five year deferral of 191(2) and at least a year of denetimli serbestlik under 191(3).

If prescribed or medical

Medicinal opium has a lawful route and prepared opium has none, and the distinction is in the statute rather than in the amount carried. Article 1 of Law No. 2313 puts medicinal opium and its preparations under ministerial control, articles 4 and 5 require an import certificate before customs will release a narcotic substance, and article 24 punishes a pharmacy selling a narcotic substance without a physician's prescription under the relevant articles of the Penal Code. The dossier recorded no prescription instrument for this row, so no per-substance medical route is asserted here; poppy derived medicines are classified product by product by the TİTCK and that classification is deferred. A foreign prescription is not a Turkish authorisation.

Documentation

Nothing documents prepared opium, poppy heads or raw opium for a traveller, because article 2 prohibits the first and article 12 closes the border to the third outside treaty terms. A traveller on a lawfully prescribed opium derived medicine should carry the original dispensing packaging, the prescription and a prescriber's letter naming the patient, the active ingredient, the dose and the treatment period, and should confirm the product with the TİTCK before travelling.
