Is Opium legal in Japan?
- Legal status
- Opium is governed by the Opium Act in Japan and by no other regime. あへん法第三条第二号 defines あへん as 「けしの液汁が凝固したもの及びこれに加工を施したもの(医薬品として加工を施したものを除く。)をいう。」, which is the coagulated juice of the poppy and anything processed from it, other than what has been processed as a medicine. Opium has its own Act and is deliberately kept out of the narcotics list. 別表第一第七十八号 catches anything containing a listed substance 「であつて、あへん以外のもの」, expressly excluding opium, because the Opium Act reserves import, export, purchase and sale to the state: 第二条 provides that those powers 「は、国に専属する。」 Morphine and codeine extracted from it are narcotics; the raw gum is not.
- Consequences if caught
- Capital and life exposure. The ceiling is a fixed term of at least one year, an indefinite term is not available under this Act at all, and no drug offence in Japan can bring the death penalty. Japan retains capital punishment and carries it out, but 死刑 appears in none of the six drug statutes, measured by searching every one of them for the word. It is available for homicide and for a small number of other offences and for no drug offence at all. 拘禁刑 replaced 懲役 and 禁錮 on 1 June 2025 under 令和四年法律第六十八号, so current texts read 拘禁刑 where older translations say imprisonment with labour. 有期拘禁刑 is a fixed term, capped at twenty years and at thirty where the term is aggravated; 無期拘禁刑 is indefinite. Across all six regimes 無期 appears exactly twice, at 麻薬及び向精神薬取締法第六十四条第二項 and at 覚醒剤取締法第四十一条第二項, and both are for profit motivated import, export or manufacture. 無期 appears nowhere in the Opium Act at all. Cultivating the poppy, harvesting opium, or importing or exporting opium or poppy straw is あへん法第五十一条第一項: 「次の各号のいずれかに該当する者は、一年以上十年以下の拘禁刑に処する。」, and 第五十一条第二項 raises it for profit to 「営利の目的で前項の罪を犯した者は、一年以上の有期拘禁刑に処し、又は情状により一年以上の有期拘禁刑及び五百万円以下の罰金に処する。」, a fixed term of at least one year with a fine of up to five million yen. Transferring, receiving or possessing opium or poppy straw is 第五十二条第一項: 「あへん又はけしがらを、みだりに、譲り渡し、譲り受け、又は所持した者(第五十五条第一号に該当する者を除く。)は、七年以下の拘禁刑に処する。」, up to seven years, rising for profit to between one and ten years with a fine of up to three million yen. The state monopoly at 第二条 is what these offences protect: 「あへんの輸入、輸出、けし耕作者及び甲種研究栽培者からの一手買取並びに麻薬製造業者及び麻薬研究施設の設置者への売渡の権能は、国に専属する。」
- If prescribed or medical
- There is no prescription route to opium itself, because Japan does not dispense it. 第二条 puts import, export, the single buyer purchase from licensed growers and the sale to narcotics manufacturers and research institutions in the hands of the state: 「あへんの輸入、輸出、けし耕作者及び甲種研究栽培者からの一手買取並びに麻薬製造業者及び麻薬研究施設の設置者への売渡の権能は、国に専属する。」 What a patient is prescribed is morphine or codeine, which are 麻薬 under the Narcotics and Psychotropics Control Act and carry the traveller permit route at 第十三条第一項ただし書. The definition at あへん法第三条第二号 is the reason those two are treated differently from the gum: opium is 「けしの液汁が凝固したもの及びこれに加工を施したもの(医薬品として加工を施したものを除く。)をいう。」, so once it has been processed into a medicine it has left the Opium Act.
- Documentation
- There is no document to carry, because there is nothing a traveller can lawfully be carrying. Opium is a state monopoly in Japan and no permit is issued to a private person for any quantity of it. The instrument behind that is あへん法, 昭和二十九年法律第七十一号, last amended by 令和四年法律第六十八号, promulgated 2022-06-17 and in force 2025-06-01. There is no list. The Opium Act works from the definitions in 第三条 rather than from a schedule. あへん法第三条第三号 defines けしがら separately from opium, so poppy straw is reached by its own route and not through the opium definition.
