Is Nitrous Oxide legal in Ireland?
- Legal status
- Nitrous oxide is not scheduled under the Misuse of Drugs Act 1977, but its sale for a psychoactive purpose is an offence under the Criminal Justice (Psychoactive Substances) Act 2010, which prohibits selling, importing or exporting nitrous oxide where it is intended to have a psychoactive effect on inhalation; medical, catering and industrial supply is lawful.
- Consequences if caught
- Selling or supplying nitrous oxide for inhalation is a psychoactive-substances offence (up to 5 years on indictment); simple personal possession is not itself criminalised. No death penalty (non-DP).
- If prescribed or medical
- Nitrous oxide is a lawful medical/anaesthetic gas and food additive (E942); legitimate healthcare and catering supply is unaffected.
- Documentation
- Catering canisters are legally sold for food use; large canisters trafficked for inhalation are seized in bulk at Dublin and Rosslare ports and prosecuted under the 2010 Act.
