Is Nitrous Oxide legal in France?
- Legal status
- Not a controlled narcotic; nitrous oxide is regulated as a consumer product under Loi n° 2021-695 of 1 June 2021 (Code de la santé publique, Livre VI, arts. L.3611-1 et seq.), which bans its sale to minors, its sale in drinking establishments, nightclubs and tobacconists, and the sale of inhalation accessories (crackers, balloons), and penalises causing a minor to misuse it for a psychoactive effect.
- Consequences if caught
- Supplying nitrous oxide to a minor for a psychoactive effect draws a €15,000 fine; adult personal possession or use is not itself criminalised. No death penalty (non-DP).
- If prescribed or medical
- Nitrous oxide stays a lawful medical/anaesthetic gas and food additive (E942); the 2021 law targets diverted recreational supply, not medical or culinary use.
- Documentation
- Cartridges remain sold for culinary use but not to minors and not in licensed drinking venues; retailers must display the misuse-danger notice and verify the buyer's age.
